1. Acceptance of these Terms

These Terms & Conditions ("Terms") are an agreement between you and Dry Sky Roofing, LLC ("Dry Sky Roofing," "Dry Sky," "we," "us," or "our"). They govern your access to and use of dry-sky.com, our online forms and content, and any text messaging program described below.

By accessing or using the website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website. If you use the website for a company, property owner, or another person, you represent that you have authority to act for them.

2. Website purpose and availability

The website provides general information about Dry Sky Roofing, our roofing and exterior services, service areas, and ways to contact us or request an inspection or estimate. Website content is for general informational purposes and does not constitute a construction, engineering, insurance, financial, or legal opinion.

We work to keep the website accurate and available, but information may be incomplete, outdated, or unavailable from time to time. We may change, suspend, or discontinue any part of the website without notice. In an emergency involving immediate danger to people or property, contact the appropriate emergency service before contacting us.

3. Inspections, estimates, and services

Submitting a form, requesting an inspection, or communicating with us does not create a contractor-client relationship, guarantee service, reserve an appointment, or require either party to enter a transaction. Availability, scheduling, service areas, and eligibility for free inspections or other offers may vary.

Any website description, preliminary conversation, or informal estimate is subject to site conditions, material availability, scope confirmation, and any written proposal or service agreement. If these Terms conflict with a signed proposal, contract, financing agreement, warranty, or other project document, that project document controls for the subject it covers.

You agree that information you provide about a property, project, insurance claim, authority to approve work, and requested service will be accurate and complete to the best of your knowledge.

4. Dry Sky Roofing text messaging program

The following terms apply when you expressly opt in to the Dry Sky Roofing Text Messaging Program.

Program description

Dry Sky Roofing may send recurring customer-care and service-related SMS or MMS messages about inspection and estimate requests, appointment scheduling and reminders, requested intake forms or documents, project and service updates, and customer support. This program does not authorize promotional or marketing messages. If we offer a separate marketing text program, we will request separate consent and provide the disclosures required for that program.

How you opt in

Where a text-message option is offered on a Dry Sky Roofing form, you may enroll by selecting the separate, unchecked text-message consent box and submitting the form. We do not treat merely submitting a service-request form, providing a phone number, calling us, or sending us a one-time text as consent to recurring program messages. By checking the box and submitting the form, you authorize Dry Sky Roofing to send the program messages described above to the mobile number you provide, including through automated technology.

You represent that you are the subscriber or customary user of that number and are authorized to provide this consent. Your consent is voluntary and is not a condition of purchasing goods or services.

Delivery and carrier terms

Carriers are not liable for any delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed. Supported carriers and program availability may change. SMS and MMS may not be available in every location or on every device.

Changing or reassigning your number

If you change, deactivate, or transfer your mobile number, you agree to opt out before the change and promptly tell us. You are responsible for keeping your contact information current. If you later want to receive messages again, you must complete a new opt-in.

Privacy

Our collection and use of information through the program are described in our Privacy Policy. We do not sell, rent, or share mobile numbers or text-message opt-in and consent data with third parties or affiliates for marketing or promotional purposes.

5. Acceptable use

You may use the website only for lawful purposes. You may not:

• Use the website to violate law, infringe another person's rights, or submit false, fraudulent, threatening, harassing, or unlawful material.
• Attempt to gain unauthorized access to the website, an account, a server, or any connected system.
• Interfere with the website's operation, security, or availability; introduce malware; or bypass technical restrictions.
• Use automated tools to scrape, overload, copy, or monitor the website except as permitted by law or with our written permission.
• Impersonate another person or misrepresent your identity, authority, or relationship to a property or project.

6. Intellectual property

The website and its text, graphics, logos, photographs, layout, software, and other content are owned by Dry Sky Roofing or used with permission and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable right to access and use the website for your personal, noncommercial use. No other rights are granted.

You may not reproduce, distribute, modify, publish, create derivative works from, publicly display, sell, license, or commercially exploit website content without prior written permission from the applicable owner.

7. Information and materials you submit

You retain ownership of information, photographs, documents, reviews, and other materials you submit. You grant Dry Sky Roofing a nonexclusive, worldwide, royalty-free license to host, store, reproduce, and use those materials as reasonably necessary to respond to you, evaluate or perform requested services, operate our business, and comply with law.

You represent that you have the rights and permissions needed to provide those materials and that our permitted use will not violate another person's rights. Please do not submit confidential or highly sensitive material through a general website form or text message unless we specifically request it through an appropriate channel.

8. Third-party websites and services

The website may contain links to third-party sites, profiles, reviews, maps, manufacturers, financing resources, social media platforms, or other services. We provide these links for convenience and do not control or endorse every third-party statement, product, practice, or security measure. Your use of a third-party service is governed by its own terms and policies.

9. Disclaimers

To the fullest extent permitted by law, Dry Sky Roofing and its owners, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities, arising from or related to your use of or inability to use the website.

This limitation applies only to website use and does not replace or limit obligations stated in a signed project agreement, liability that cannot lawfully be limited, or rights and remedies that cannot lawfully be waived.

11. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Dry Sky Roofing and its owners, employees, and agents from claims, damages, losses, liabilities, and reasonable costs arising from your unlawful misuse of the website, your material breach of these Terms, or content you submit in violation of another person's rights.

12. Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Any dispute relating solely to the website or these Terms must be brought in a state or federal court with jurisdiction in North Carolina, and each party consents to that court's jurisdiction. A signed project agreement may contain different dispute terms that control disputes about that project.

13. Changes to the website or these Terms

We may update these Terms from time to time. The revised version will be posted on this page with a new effective date. Changes apply prospectively when posted, unless a later date is stated or applicable law requires otherwise. Continuing to use the website after revised Terms take effect means you accept them.

We may modify or discontinue the text messaging program or change its message content or frequency. If a change requires new consent under applicable law, we will request that consent before sending messages covered by the change.

14. General terms

If any provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, reorganization, financing, sale, or transfer of our business or assets, but text-message consent does not transfer to another sender and must be obtained directly where required by law.

These Terms, together with the Privacy Policy, are the entire agreement between you and Dry Sky Roofing regarding the website and text messaging program. They do not replace a signed agreement for roofing, exterior, inspection, repair, warranty, financing, or other services.
